Civil, Commercial, Property, and Contractual Disputes

The Chambers handles civil, commercial, property, and contractual disputes before District Courts, Commercial Courts, the High Court of Delhi, and appellate forums, including suits for injunction, declaration, possession, recovery, specific performance, partition, accounts, damages, enforcement of contractual rights, and proceedings requiring urgent interim relief.

Property and real estate disputes form a significant part of this work. We handle title disputes, possession claims, landlord-tenant matters, disputes arising from agreements to sell, inheritance-linked property disputes, cooperative housing matters, development-related disputes, and litigation involving allotments or actions by public authorities.

On the commercial side, we handle breach of contract, recovery of dues, enforcement of guarantees, disputes between business partners, shareholder & partnership conflicts, commercial lease & licence disputes, and cheque dishonour proceedings under Section 138 of the Negotiable Instruments Act, alongside drafting and review of commercial agreements, settlement deeds, guarantees, leases, and confidentiality arrangements arising from a dispute, transaction, settlement, or risk assessment. This litigation frequently turns on specific procedural and evidentiary thresholds: securing interim relief by satisfying the triad of a prima facie case, balance of convenience, and irreparable injury; proving readiness and willingness under Section 16(c) of the Specific Relief Act, 1963 in specific performance claims; establishing possession handed over pursuant to an unregistered agreement to sell; and questions under the Benami Transactions (Prohibition) Act, 1988, where property is held in one family member’s name for another’s benefit: matters in which we act on both the assertion and the defence of benami claims.

Beyond litigation, we undertake due diligence and title verification for property transactions, structuring and vetting agreements to sell, lease deeds, and development agreements to pre-empt future disputes, and risk assessment of commercial contracts before execution, aimed at identifying points of likely contention before they mature into litigation.
